Conditions of use

Article I – Introductory Provisions 

  1. The University of Pardubice pays attention to the quality of its educational and creative activities and carries out its regular evaluation, in which it relies, inter alia, on feedback processes. 
  1. The University of Pardubice values all its graduates and is aware that the feedback it can receive from them is invaluable. 
  1. Not only for this reason, the University of Pardubice is interested in staying in touch with its graduates and in further cooperation, and for this purpose it implements the Alumni Program. 
  1. The Alumni Program consists of many components. The entry point is the Alumni Register, which is followed by other services provided by the University of Pardubice within the Alumni Program ("other services").  

 

Article II – The Alumni Register 

  1. The Alumni Register is a service available at the Internet address (URL) http://absolventi.upce.cz ("Alumni Register"). 

Alumni Register is a service which, under the conditions agreed in this Agreement, allows its users, in particular, to:

  • register and verify the eligibility to be included in the Alumni Program, 
  • enter and update contact details for the needs of communication with the University of Pardubice, 
  • enter and update other data (e.g. data on profession and employment) as part of the feedback to the University of Pardubice, 
  • obtain an Alumni Card and 
  • perform administration of other services
  1. The operator of the Alumni Register and the party to this Agreement is the University of Pardubice, with its registered office at Studentská 95, 532 10 Pardubice, Company Registration Number 00216275, VATIN CZ00216275 ("University of Pardubice"). The University of Pardubice is a legal entity and a public university established by law. 

 

Article III – Users of the Alumni Register 

  1. The Alumni Register is intended only for graduates of undergraduate, postgraduate or doctoral study programmes implemented at the University of Pardubice or by its legal predecessors.
  1. The condition for participation in the Alumni Register is the verification of their alumni status on the basis of data on studies completed by the User. 
  1. A user for whom information on completed studies has been verified ("verified user"), acquires unlimited access and the right to draw benefits and use the services provided within the Alumni Program. 
  1. If the nature of specific services so requires, verification of the User's identity may also be performed ("identified user"). 

 

Article IV – Conclusion of the Agreement with the User 

  1. By checking the box "I accept the terms and conditions" and filling in the e-mail address in the Alumni Register registration form and then using the activation link sent to the e-mail address entered, the User confirms that he/she has concluded an Agreement with the University of Pardubice and read it in full. Furthermore, the User declares that he/she acknowledges that the contractual relationship between him/her and the University of Pardubice will be governed by these terms and conditions and other conditions stated herein. 
  1. Pursuant to this Agreement, the University of Pardubice undertakes, in accordance with the conditions and exclusion of liability under this Agreement (see Article VIII), to provide users with free access to the Alumni Register and the User undertakes to use the Alumni Register service in accordance with the provisions of this Agreement. 
  2. The contractual relationship between the User and the University of Pardubice is further governed by the Cookies Policy and the Personal Data Processing Policy, which govern the manner in which the University of Pardubice collects, handles, shares and stores the User's personal data in connection with the operation of the Alumni Register
  1. The University of Pardubice provides the Alumni Register services to its users free of charge. 
  1. These terms and conditions apply to the Alumni Register services.  
  1. Specific terms and conditions may apply to other services, to which the User must accede when activating other services.  
  1. User registration, and thus the conclusion of the Agreement for the services of the Alumni Register, is thus a necessary, but not necessarily sufficient precondition for the possibility of using other services provided within the Alumni Program. 

 

Article V – Account, Profile and Access Data 

  1. Anyone who accepts these terms and conditions is created on the basis of registration a temporarily and functionally limited account within the Alumni Register (hereinafter referred to as the "limited user account"). Based on the registration, a temporarily and functionally limited account is created within the Alumni Register ("limited user account") to anyone who accepts these terms and conditions. 
  1. The limited user account pursuant to Paragraph 18 until the successful verification of the graduate status does not entitle the User to draw benefits and use the services provided within the Alumni Program.  
  1. The limited user account referred to in Paragraph 18 shall be used only for communication by the User regarding the verification of his/her graduate status, in particular for filling in the required data necessary for verification.
  1. Within the limited user account, the User may voluntarily provide additional data in addition to the data necessary for verification.  
  1. The limited user account referred to in Paragraph 18 shall be of a temporary nature only, and if the User fails to complete the data necessary to verify his/her graduate status within 30 days at the latest, the account shall be terminated and the user profile deleted.
  1. Upon successful verification of the graduate status, the limited user account pursuant to Paragraph 18 becomes a full-fledged user account, which establishes the right of the User to draw benefits and use the services provided within the Alumni Program. 
  1. The user account is secured with access data entered by the User during registration.  
  2. The User is obliged to store the access data to the Alumni Register so that these access data cannot be misused or used in any way by a third party. Above all, the User is obliged to protect the access data from loss, disclosure, theft or misuse. If there is a loss, misuse, or theft of access data, the User is obliged to immediately notify the University of Pardubice, namely the Department of Promotion and External Relations.  
  1. The User undertakes not to allow the use of the Alumni Register via his/her access data to third parties. The User is liable for any damage incurred by the University of Pardubice due to violating these obligations. The University of Pardubice is not liable to users for any misuse of access data by a third party or for unauthorized use of the Alumni Register via the User's access data by a third party. 
  1. The User has the right to change the access data at any time, but undertakes to protect and keep this data secret.  
  1. The User is fully responsible for everything that happens through his/her account, except in cases where the User cancels it or reports its misuse.  
  1. With regard to the purposes of the Alumni Register, the User is obliged to use the Alumni Register under his/her real identity. 
  1. The User has the right to manage his/her personal profile and set the scope of his/her privacy, especially in terms of making the entered data available to other services
  1. Mandatory data provided by the User, which are necessary for opening an account in the Alumni Register, are name, surname, year of birth and contact e-mail, as well as data for at least one completed study to the extent of the year of graduation, surname at the time of graduation, faculty, completed program (including type and form) and branch of study. 

 

Article VI – Alumni Card 

  1. The Alumni Card proves the affiliation of its holder to the alumni community of the University of Pardubice and allows him/her to use a number of benefits and services provided within the Alumni Program.
  1. The Alumni Card comes in the form of a plastic card provided with the name and surname of the holder and a bar code bearing the identification mark of the card.
  1. The verified user of the Alumni Register is entitled to the Alumni Card on the basis of an application submitted via his/her profile in the Alumni Record. 
  1. The Alumni Card is issued free of charge and its validity is unlimited in time.
  1. The Alumni Card is the property of the University of Pardubice and is non-transferable.
  1. The Alumni Card is made in several visual styles, from which the User can choose within the application.
  1. The User has the right to choose whether the Alumni Card will be delivered to him/her by post or whether he/she will pick it up in person at the issuing point of the University of Pardubice. If the Alumni Card is to be delivered by post, the User is obliged to state his/her postal address.
  1. Upon receipt of the Alumni Card, the User is obliged to prove his/her identity. 
  1. In case of loss, theft or damage to the Card, the User is entitled to issue a new Alumni Card. However, reissue may be subject to a charge of CZK 100. 
  1. Upon termination of this Agreement, the Holder is obliged to destroy or return the Alumni Card at the issuing point of the University of Pardubice

Article VII – Rights and Obligations 

  1. The University of Pardubice is entitled to: 
  1. change, suspend or terminate the operation of the Alumni Register or the provision of the Alumni Program at any time, 
  1. limit, suspend or cancel the User's account in the Alumni Register if the User violates this Agreement in any way, especially if he/she abuses the services of the Alumni Program or his/her actions lead to any violation of Czech law. 
  1. The User is entitled to: 
  1. use all services provided by the Alumni Register, in accordance with this Agreement and other documents binding on the User free of charge, 
  1. activate or deactivate the use of other services
  1. access all information and personal data concerning him/her, 
  1. demand that the University of Pardubice store, process and use personal data only in accordance with this Agreement, the conditions of the Personal Data Processing Policy and the User's preferences (settings), 
  1. cancel his/her account in the Alumni Register
  1. The User undertakes to: 
  1. comply with the provisions of this Agreement and other documents binding on the User when using the Alumni Register
  1. keep his/her profile in the Alumni Register true and up to date
  2. if he/she has been issued an Alumni Card, report its possible loss or theft and, in the event of termination of this Agreement, return the Alumni Card at the issuing point of the University of Pardubice or destroy it. 
  1. The User is not authorized to (may not): 
  1. create a false identity in the Alumni Register, distort his/her identity, create a user profile for anyone other than himself/herself, or use or attempt to use someone else's account, 
  1. develop, support or use software, devices, scripts, robots or any other means or procedures (including web crawlers, browser plug-ins and add-ons or any other technology) to obtain data from the Alumni Register and other services
  1. disable any security functions or bypass or deceive any access control tools or restrictions on the use of the Alumni Register
  1. reverse engineer, decompile, disassemble, decrypt or otherwise attempt to obtain the source code of the Alumni Register or other services or any related technology that is not open source software, 
  1. copy or otherwise simulate in any way the appearance or function of the Alumni Register
  1. disrupt the operation of the Alumni Register or place an unreasonable burden on it (e.g. by spam, attack, etc.). 
  1. The User agrees that the University of Pardubice is entitled to send him/her notifications and messages via the contact details given in the Alumni Register, which are related to the provision of Alumni Program services, obtaining feedback and offers of cooperation between the User and the University of Pardubice. 

 

Article VIII – Disclaimer and Limitation of Liability 

  1. DISCLAIMER OF LIABILITY FOR DEFECTS. The University of Pardubice does not provide any guarantees regarding the functions and availability of the Alumni Register. The University is not responsible for ensuring that the operation of the Alumni Register is uninterrupted or error-free. The University of Pardubice provides the Alumni Evidence service on an "as is" and "as available" basis. To the fullest extent possible, in accordance with applicable law, the University of Pardubice excludes any liability for defects or warranty, ownership, accuracy of data or suitability for a particular purpose. 
  1. EXCLUSION OF LIABILITY FOR DAMAGE. To the fullest extent possible, in accordance with applicable law, the Contracting Parties hereby exclude, in connection with this Agreement and the operation of the Alumni Register, the liability of the University of Pardubice for damage (actual damage and lost profits), damage to reputation or interference with the protection of personality rights, loss of data or any other indirect, incidental, consequential, special or criminal damages. The limitation of liability pursuant to the preceding provision shall not apply to liability in cases where Act No. 89/2012 Sb., The Civil Code, as amended, or another legal regulation expressly prohibits the limitation of damages. 
  1. SERVICE AVAILABILITY. The University of Pardubice does not provide any guarantee of continuous functionality, faultless operation and security of the Alumni Register system. The University of Pardubice does not bear any responsibility for interruption of services due to technical problems. The University of Pardubice is not responsible for any loss of data located in the Alumni Register system. The University of Pardubice is entitled, at the exclusion of any liability for damage or loss of data, to change, suspend or terminate the operation of the Alumni Register at any time. 

 

Article IX – Termination of the Agreement, Account Cancellation

  1. Either party is entitled to terminate this Agreement at any time upon written notice to the other party. Upon termination of the Agreement by the User, the notification may be addressed to the University of Pardubice, namely the Department of Promotion and External Relations. Cancellation by the User through the user account is also considered termination of the Agreement.
  1. Upon termination of the Agreement, the User shall lose the right to access and use the Alumni Register, the user account will be cancelled. 
  1. Upon termination of the Agreement, the User shall also lose the right to access other services that he/she activated through the Alumni Register. User accounts for other services shall be terminated according to the rules set out in the terms of specific other services

 

Article X – Protection of Personal Data 

  1. Within the meaning of Regulation No. 2016/679 of the European Parliament and of the Council (EU) on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC ("General Regulation or Regulation"), the University of Pardubice is a controller of personal data, which means that it determines the purpose and means of processing personal data, performs the processing of personal data of natural persons and is responsible for such processing.  
  1. The University of Pardubice provides users – natural persons – with information on the method of personal data processing and information on the most common types of personal data processing that occurs during the operation of the Alumni Register, through a special document – Personal Data Processing Policy

 

Article XI – Dispute Resolution and Jurisdiction of the Courts 

  1. The Parties to the Agreement undertake to seek to primarily resolve all disputes arising from this Agreement amicably. If it is not possible to resolve a dispute amicably, the Parties to the Agreement agree that all disputes arising from this Agreement and related to this Agreement will be resolved in a court having subject-matter and territorial jurisdiction in the Czech Republic, according to the legislation in force in the Czech Republic with the exclusion of conflict of laws. 

 

Article XII – Severability

  1. If any obligation under this Agreement, but not essential to it, is or becomes invalid or unenforceable in whole or in part, is fully severable from the other provisions of this Agreement and such invalidity or unenforceability shall not affect the validity and enforceability of any other obligations under this Agreement.  

 

Article XIII – Effectiveness of the Agreement, Changes to the Agreement

  1. UPDATES AND CHANGES TO THE AGREEMENT. The University of Pardubice reserves the right to unilaterally amend this Agreement to a reasonable extent, especially in the event of a change in legislation, a technical change in the operation of the Alumni Register, due to the development or expansion of the Alumni Register, or in the event of a change in operational, organizational or business processes, and therefore the Parties agree in this regard that the University of Pardubice is entitled to make changes to this Agreement, as well as to Personal Data Processing PolicyCookies Policy or other documents binding on users. 
  1. If the University of Pardubice makes any substantial changes to this Policy, it is obliged to notify the User of this fact via the e-mail address provided by the User in his/her profile or otherwise, so that the User has the opportunity to familiarize himself/herself with the changes before they take effect.  
  1. If the user does not agree with the proposed changes to this Policy, he/she is entitled to cancel his/her account.
  1. If the User does not accept the new terms and conditions for the Alumni Register within the specified time after the University of Pardubice publishes changes to this Policy and sends the User a notification, the User shall be deemed not to agree with the changes as of the date of their entry into force and his/her account shall be cancelled. 
  1. These terms and conditions for the use of the Alumni Register shall enter into force and effect on June 19, 2020.
